The quarantine of animals and animal products entering or leaving the territory shall be governed by the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering or Leaving the Territory.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 3 For the purposes of this Law, "animals" means livestock, poultry and other animals raised by artificial means or legally captured.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 6 The administrative department of animal husbandry and veterinary medicine under the State Council shall be in charge of animal epidemic prevention work throughout the country.文章源自FOFCC-http://fofcc.org.cn/am/11216/
The administrative departments of animal husbandry and veterinary medicine of the local people's governments at or above the county level shall be in charge of animal epidemic prevention work within their respective administrative regions.文章源自FOFCC-http://fofcc.org.cn/am/11216/
The animal epidemic prevention supervision institutions under the people's governments at or above the county level shall implement animal epidemic prevention and animal epidemic prevention supervision.文章源自FOFCC-http://fofcc.org.cn/am/11216/
The animal epidemic prevention supervision institutions of the armed forces shall be responsible for the epidemic prevention work of animals on active service and animals raised by the armed forces for their own use.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 8 The State shall encourage and support scientific research on animal epidemic prevention, popularize advanced scientific research achievements, disseminate scientific knowledge of animal epidemic prevention and raise the level of animal epidemic prevention.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 9 Units and individuals that have made achievements and contributions in animal epidemic prevention work and scientific research on animal epidemic prevention shall be rewarded by the people's governments or the administrative departments of animal husbandry and veterinary medicine.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Chapter II Prevention of Animal Epidemics文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 10 According to the degree of harm that animal epidemics may cause to the production of the breeding industry and human health, the animal epidemics to be managed as prescribed by this Law are divided into the following three categories:文章源自FOFCC-http://fofcc.org.cn/am/11216/
(1) Category I epidemics, which means those that seriously endanger human beings and animals and require urgent and strict compulsory measures for prevention, control and stamping out;文章源自FOFCC-http://fofcc.org.cn/am/11216/
(2) Category II epidemics, which means those that may cause major economic losses and require strict control and stamping out measures to prevent spread;文章源自FOFCC-http://fofcc.org.cn/am/11216/

The specific list of diseases of the three categories of epidemics mentioned in the preceding paragraph shall be formulated and announced by the administrative department of animal husbandry and veterinary medicine under the State Council.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 11 The administrative department of animal husbandry and veterinary medicine under the State Council shall formulate a national plan for the prevention of animal epidemics.文章源自FOFCC-http://fofcc.org.cn/am/11216/
The administrative department of animal husbandry and veterinary medicine under the State Council shall, in light of the animal epidemic situation at home and abroad and the need to protect the production of the breeding industry and human health, promptly formulate and announce measures for the prevention of animal epidemics.文章源自FOFCC-http://fofcc.org.cn/am/11216/
The State shall implement a planned immunization system and compulsory immunization for animal epidemics that seriously endanger the production of the breeding industry and human health. For the prevention of animal epidemics other than those subject to compulsory immunization, the administrative departments of animal husbandry and veterinary medicine of the local people's governments at or above the county level shall formulate plans and submit them to the people's governments at the same level for approval before implementation.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 12 The State shall take measures to prevent and stamp out animal epidemics that seriously endanger the production of the breeding industry and human health.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Medicines, biological products and related materials needed for the prevention and stamping out of animal epidemics shall be kept in appropriate reserve and incorporated into the national economic and social development plan.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 13 Animal epidemic prevention supervision institutions shall strengthen publicity and education, technical guidance, technical training and consulting services for the prevention of animal epidemics, and organize the implementation of animal epidemic immunization plans.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Animal epidemic prevention organizations in townships, ethnic townships and towns shall, under the guidance of animal epidemic prevention supervision institutions, organize and carry out animal epidemic prevention work.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 17 Those who preserve, use or transport animal-derived pathogenic microorganisms shall comply with the management system and operating procedures prescribed by the State.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Where animal pathological materials are transported due to special needs such as scientific research, teaching and epidemic prevention, they shall be transported in accordance with relevant State regulations. Article 19 The administrative department of animal husbandry and veterinary medicine under the State Council shall uniformly manage and announce the national animal epidemic situation, and may, as needed, authorize the administrative departments of animal husbandry and veterinary medicine of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to announce the animal epidemic situation within their respective administrative regions.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 20 Any unit or individual that discovers animals suffering from or suspected of suffering from an epidemic disease shall promptly report to the local animal epidemic prevention supervision institution. Article 21 When a Category I animal epidemic occurs, the administrative department of animal husbandry and veterinary medicine of the local people's government at or above the county level shall immediately send personnel to the scene, delineate the epidemic point, epidemic area and threatened area, collect pathological materials, investigate the source of the epidemic, promptly request the people's government at the same level to decide to impose a blockade on the epidemic area, and report the epidemic situation and other circumstances level by level to the administrative department of animal husbandry and veterinary medicine under the State Council.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Local people's governments at or above the county level shall immediately organize the relevant departments and units to take mandatory control and eradication measures such as isolation, culling, destruction, disinfection, and emergency immunization, so as to quickly eradicate the epidemic disease, and shall notify adjacent areas.文章源自FOFCC-http://fofcc.org.cn/am/11216/
During the blockade period, it is prohibited for infected and suspected infected animals and animal products to flow out of the epidemic area, and for animals from non-epidemic areas to enter the epidemic area; and, as required for eradicating the animal epidemic disease, disinfection and other restrictive measures shall be taken for personnel, means of transport, and related articles entering and leaving the blockade area.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Where the scope of the epidemic area involves two or more administrative regions, the people's government at the next higher level common to the relevant administrative regions shall decide to impose a blockade on the epidemic area, or the people's governments at the next higher level of each relevant administrative region shall jointly decide to impose a blockade on the epidemic area.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 22 When a Class II animal epidemic disease occurs, the animal husbandry and veterinary administrative department of the local people's government at or above the county level shall delineate the epidemic point, epidemic area, and threatened area.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Local people's governments at or above the county level shall, as needed, organize the relevant departments and units to take control and eradication measures such as isolation, culling, destruction, disinfection, emergency immunization, and restriction of the entry and exit of susceptible animals, animal products, and related articles.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 23 The lifting of the blockade of the epidemic point, epidemic area, and threatened area shall be announced by the original deciding authority.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 24 When a Class III animal epidemic disease occurs, the county-level and township-level people's governments shall, in accordance with the animal epidemic disease prevention plan and the relevant provisions of the animal husbandry and veterinary administrative department of the State Council, organize prevention, treatment, and purification.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 26 In order to control and eradicate major animal epidemics, animal epidemic prevention supervision institutions may send personnel to participate in existing inspection stations established according to law in the locality to carry out supervision and inspection tasks; when necessary, with the approval of the people's government of the province, autonomous region, or municipality directly under the Central Government, temporary animal epidemic prevention supervision and inspection stations may be established to carry out supervision and inspection tasks.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 27 When a zoonotic epidemic disease occurs, the relevant animal husbandry and veterinary administrative department shall mutually notify the health administrative department and relevant units of the epidemic situation. Article 31 Animal epidemic prevention supervision institutions shall establish animal quarantine officers to specifically implement quarantine of animals and animal products. Animal husbandry and veterinary administrative departments at or above the county level shall strengthen the training, assessment, and management of animal quarantine officers. Animal quarantine officers may take up their posts to implement quarantine only after obtaining the corresponding qualification certificates. The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall prescribe the types of animals and the scope of areas within their administrative regions where designated slaughtering and centralized quarantine are implemented; the specific slaughterhouses (points) shall be determined through study by the city (including cities not divided into districts) and county people's governments organizing the relevant departments.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Animal epidemic prevention supervision institutions shall implement quarantine on animals slaughtered at slaughterhouses (points) and affix the inspection completion seal uniformly used by animal epidemic prevention supervision institutions. Article 33 For the quarantine of pigs and other animals slaughtered by farmers for their own use, the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall formulate management measures.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 34 Animal epidemic prevention supervision institutions conducting quarantine according to law shall collect quarantine fees in accordance with the provisions of the finance and price administrative departments of the State Council, and shall not collect additional fees or repeatedly collect fees.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 36 For the introduction of breeding animals and their semen, embryos, and breeding eggs from other places within the country, quarantine approval procedures must first be completed with the local animal epidemic prevention supervision institution, and the quarantine must be passed.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 37 Wild animals captured by humans that may transmit animal epidemic diseases must pass quarantine by the animal epidemic prevention supervision institution at the place of capture or the place of receipt before they may be sold and transported.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 38 For animals and animal products that pass quarantine, the animal epidemic prevention supervision institution shall issue a quarantine certificate, and for animal products, the inspection completion mark used by the animal epidemic prevention supervision institution shall also be affixed or sealed.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 39 Animals shall be sold, transported, exhibited, performed, and entered into competitions on the strength of quarantine certificates. Article 41 Animal epidemic prevention supervision institutions shall supervise animal epidemic prevention work according to law.文章源自FOFCC-http://fofcc.org.cn/am/11216/
When performing monitoring and supervision tasks, animal epidemic prevention supervision institutions may sample, retain for inspection, and conduct spot checks on animals and animal products, conduct supplementary or repeat quarantine on animals and animal products without quarantine certificates, and isolate, seal up, and handle infected or suspected infected animals and infected animal products.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 42 For the transport of animals and animal products by railway, highway, waterway, or air, the consignor must provide a quarantine certificate before consignment; the carrier must rely on the quarantine certificate before carrying.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 45 Units such as animal rearing farms, slaughterhouses, meat processing plants, and other designated slaughterhouses (points), when engaging in animal rearing, business operations, and the production and business activities of animal products, shall comply with the animal epidemic prevention conditions prescribed by the animal husbandry and veterinary administrative department of the State Council and shall accept supervision and inspection by animal epidemic prevention supervision institutions.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Engaging in animal diagnosis and treatment activities shall require corresponding professional and technical personnel and shall obtain an animal diagnosis and treatment license issued by the animal husbandry and veterinary administrative department.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 46 Anyone who violates the provisions of this Law and commits any of the following acts shall be given a warning by the animal epidemic prevention supervision institution; if the person refuses to correct, the animal epidemic prevention supervision institution shall, according to law, handle the matter on the person's behalf, and the costs required for handling shall be borne by the violator:文章源自FOFCC-http://fofcc.org.cn/am/11216/
(1) failing to timely carry out immunization and disinfection for animals raised or operated in accordance with the mandatory animal epidemic immunization plan and relevant State provisions;文章源自FOFCC-http://fofcc.org.cn/am/11216/
(2) failing to clean and disinfect the means of transport, bedding, and packaging for animals and animal products in accordance with relevant State provisions;文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 47 Anyone who, in violation of Article 17 of this Law, preserves, uses, or transports animal-derived pathogenic microorganisms or transports animal pathological materials shall be given a warning by the animal epidemic prevention supervision institution and may also be fined not more than 2,000 yuan.文章源自FOFCC-http://fofcc.org.cn/am/11216/
Article 48 Anyone who, in violation of the provisions of this Law, deals in any of the following animals or animal products shall be ordered by the animal epidemic prevention supervision institution to stop the business operations, immediately take effective measures to recall the animals or animal products already sold, confiscate the illegal gains and the unsold animals or animal products; if the circumstances are serious, a fine of not more than 5 times the illegal gains may also be imposed:文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 49 Anyone who, in violation of the provisions of this Law, deals in animals or animal products that should be quarantined according to law but for which there is no quarantine certificate shall be ordered by the animal epidemic prevention supervision institution to stop the business operations and shall have the illegal gains confiscated; the unsold animals or animal products shall be subject to supplementary quarantine according to law and handled in accordance with Article 38 of this Law.文章源自FOFCC-http://fofcc.org.cn/am/11216/

Article 55: Where an animal quarantine officer, in violation of the provisions of this Law, issues a quarantine certificate or affixes an inspection seal for animals or animal products that have not been quarantined or have failed quarantine, the unit to which he or she belongs or the competent authority at a higher level shall give him or her a demerit record or revoke his or her qualification as an animal quarantine officer; if the circumstances are serious, he or she shall be given the sanction of dismissal.
