In 2023, the United States Department of Agriculture (USDA) released an enhanced version of the U.S. Organic Program, which will take effect in March 2024. Under this program, all organic product transactions must apply to certification bodies for a sales certificate, and exports to the United States must use a dedicated sales certificate. - After March 2024, all organic products exported to the United States must hold a U.S.-bound dedicated sales certificate for customs clearance.
- For a U.S.-bound dedicated sales certificate, once issued, all information cannot be modified, and another replacement U.S.-bound dedicated sales certificate must be applied for.
- After March 2024, exporters, producers, and importers must all be certified; otherwise, the corresponding enterprise/organization name cannot be entered into the system.
- For organic goods exported to the United States, sales certificate application materials should be submitted before departure for review by the certification body; however, there is currently no requirement to issue the sales certificate before departure.
- Products obtaining FOFCC Canadian organic certification and exported to the United States under the Canada-U.S. equivalency agreement must also use the U.S. Organic Integrity Database to issue a U.S.-bound dedicated sales certificate.
- For organic products exported to the United States, the outer packaging, bill of lading, pro forma invoice, etc., must use the organic label, that is, the word “organic” must be marked before the product name. U.S. Customs will inspect this during customs clearance of the goods.
