In 2023, the United States Department of Agriculture (USDA) published the Strengthening Organic Enforcement (SOE) final rule, which will take effect in March 2024. Under this rule, all organic product transactions must apply to the certification body for a sales certificate, and exports to the United States must use a dedicated sales certificate. The USDA has upgraded the Organic Integrity Database (OID), in which dedicated sales certificates for exports to the United States can be issued. IBD and FOFCC have also officially activated this database to issue dedicated sales certificates for exports to the United States.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/22520/
All US organic and Canada organic certified organizations are requested to pay attention to the following new changes:Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/22520/
- After March 2024, all organic products exported to the United States must hold a dedicated sales certificate for exports to the United States for customs clearance.
- For a dedicated sales certificate for exports to the United States, once issued, all information cannot be modified; a replacement dedicated sales certificate for exports to the United States must be applied for separately.
- After March 2024, exporters, producers, and importers must all be certified; otherwise, the corresponding enterprise/organization name cannot be entered into the system.
- For organic goods exported to the United States, the sales certificate application materials should be submitted before departure for review by the certification body; however, there is currently no requirement to issue the sales certificate before departure.
- For products certified under FOFCC Canada Organic Certification and exported to the United States under the Canada-US equivalency agreement, a dedicated sales certificate for exports to the United States must also be issued using the USDA Organic Integrity Database.
- For organic products exported to the United States, the outer packaging, bill of lading, pro forma invoice, etc., must use the organic label, i.e., the word “organic” must be marked before the product name. US Customs will inspect this during customs clearance.
