In 2023, the United States Department of Agriculture (USDA) published the Strengthening Organic Enforcement (SOE) final rule, which will take effect in March 2024. Under this rule, all organic product transactions must apply to the certification body for a sales certificate, and exports to the United States must use a dedicated sales certificate. The USDA has upgraded the Organic Integrity Database (OID), in which the dedicated sales certificate for exports to the United States can be issued. IBD and FOFCC have also officially activated this database to issue the dedicated sales certificate for exports to the United States.บทความมาจากFOFCC-http://fofcc.org.cn/th/22520/
All US organic and Canadian organic certified organizations are requested to pay attention to the following new changes:บทความมาจากFOFCC-http://fofcc.org.cn/th/22520/
- After March 2024, all organic products exported to the United States must be accompanied by the dedicated sales certificate for exports to the United States for customs clearance.
- Once the dedicated sales certificate for exports to the United States is issued, all information on it cannot be modified; a replacement dedicated sales certificate for exports to the United States must be applied for separately.
- After March 2024, exporters, producers, and importers must all be certified; otherwise, the corresponding enterprise/organization name cannot be entered into the system.
- For organic goods exported to the United States, the sales certificate application materials should be submitted before departure for review by the certification body; however, there is currently no requirement to issue the sales certificate before departure.
- For products certified under FOFCC Canadian Organic Certification and exported to the United States under the Canada-US equivalency agreement, the dedicated sales certificate for exports to the United States must also be issued through the USDA Organic Integrity Database.
- For organic products exported to the United States, the outer packaging, bill of lading, pro forma invoice, etc., must bear the organic mark, i.e., the word “organic” must be indicated before the product name. US Customs will conduct inspections during customs clearance of the goods.
