Article 1 These Regulations are formulated in accordance with the provisions of the Standardization Law of the People's Republic of China (hereinafter referred to as the "Standardization Law").文章源自FOFCC-http://fofcc.org.cn/am/11217/

(2) Methods of design, production, inspection, packaging, storage, transportation, and use of industrial products, or safety and health requirements in the processes of production, storage, and transportation.文章源自FOFCC-http://fofcc.org.cn/am/11217/
(3) Various technical requirements and inspection methods relating to environmental protection.文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 3 The State shall develop standardization undertakings in a planned manner. Standardization work shall be incorporated into national economic and social development plans at all levels.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 4 The State encourages the adoption of international standards and advanced foreign standards, and actively participates in the formulation of international standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 3 The tasks of standardization work are to formulate standards, organize the implementation of standards, and supervise the implementation of standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 6 The administrative department for standardization under the State Council shall uniformly administer standardization work throughout the country and perform the following duties:文章源自FOFCC-http://fofcc.org.cn/am/11217/
(1) Organize the implementation of laws, regulations, guidelines, and policies of the State concerning standardization work;文章源自FOFCC-http://fofcc.org.cn/am/11217/

(3) Organize the formulation of national standards;文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 7 The relevant administrative departments under the State Council shall manage, according to the division of duties, the standardization work of their respective departments and industries, and perform the following duties:文章源自FOFCC-http://fofcc.org.cn/am/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State concerning standardization work, and formulate specific measures for implementation within their respective departments and industries;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(2) Formulate standardization work plans and programs for their respective departments and industries;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(3) Undertake the task assigned by the State of drafting national standards, and organize the formulation of industry standards;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(4) Guide the standardization work of the relevant administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government;文章源自FOFCC-http://fofcc.org.cn/am/11217/

(7) Upon authorization by the administrative department for standardization under the State Council, manage, according to the division of duties, product quality certification work in their respective industries.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 8 The administrative departments for standardization of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall uniformly administer standardization work within their respective administrative regions and perform the following duties:文章源自FOFCC-http://fofcc.org.cn/am/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State concerning standardization work, and formulate specific measures for implementation within their respective administrative regions;文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 9 The relevant administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government shall manage, according to the division of duties, the standardization work of their respective departments and industries within their respective administrative regions, and perform the following duties:文章源自FOFCC-http://fofcc.org.cn/am/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State and of their respective departments, industries, and administrative regions concerning standardization work, and formulate specific measures for implementation;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(2) Formulate standardization work plans and programs for their respective departments and industries within their respective administrative regions;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(3) Undertake the task assigned by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government of drafting local standards;文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 10 The division of duties between the administrative departments for standardization and the relevant administrative departments of cities and counties shall be prescribed by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Chapter III Formulation of Standards文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 11 National standards (including the preparation of standard samples) shall be formulated for the following technical requirements that need to be unified throughout the country:文章源自FOFCC-http://fofcc.org.cn/am/11217/
(1) Requirements for interchangeability and compatibility and general technical language;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(2) Technical requirements for safeguarding human health and the safety of persons and property;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(3) Technical requirements for basic raw materials, fuels, and materials;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(4) Technical requirements for general-purpose basic parts;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(5) General-purpose testing and inspection methods;文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 12 The national standards shall be planned, organized for drafting, uniformly examined and approved, numbered and issued by the administrative department for standardization under the State Council.文章源自FOFCC-http://fofcc.org.cn/am/11217/
The national standards for engineering construction, pharmaceuticals, food hygiene, veterinary drugs and environmental protection shall be organized for drafting and examined and approved by the competent departments for engineering construction, health, agriculture and environmental protection under the State Council respectively; the measures for their numbering and issuance shall be formulated by the administrative department for standardization under the State Council together with the relevant competent departments under the State Council.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Where the law provides otherwise for the formulation of standards, the provisions of the law shall prevail.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 13 For technical requirements for which no national standards have been formulated but which need to be unified within a certain industry throughout the country, industry standards may be formulated (including the preparation of standard samples). Article 14 Industry standards shall be planned, organized for drafting, uniformly examined and approved, numbered and issued by the relevant competent departments under the State Council, and shall be reported to the administrative department for standardization under the State Council for the record.文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 15 For safety and hygiene requirements for industrial products for which no national standards or industry standards have been formulated but which need to be unified within the scope of a province, autonomous region or municipality directly under the Central Government, local standards may be formulated. Article 16 Local standards shall be planned, organized for drafting, uniformly examined and approved, numbered and issued by the administrative department for standardization of the people's government of the province, autonomous region or municipality directly under the Central Government, and shall be reported to the administrative department for standardization under the State Council and the relevant competent departments under the State Council for the record.文章源自FOFCC-http://fofcc.org.cn/am/11217/

Article 17 Where there are no national standards, industry standards or local standards for products produced by an enterprise, the enterprise shall formulate corresponding enterprise standards as the basis for organizing production. Enterprise standards shall be formulated by the enterprise itself (measures for formulating standards for agricultural enterprises shall be separately prescribed), and shall be filed for the record in accordance with the provisions of the people's government of the province, autonomous region or municipality directly under the Central Government.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Where national standards, industry standards or local standards already exist, enterprises are encouraged to formulate enterprise standards stricter than the requirements of the national standards, industry standards or local standards, for application within the enterprise.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 18 National standards and industry standards shall be divided into mandatory standards and recommended standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/

(1) Pharmaceutical standards, food hygiene standards and veterinary drug standards;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(2) Safety and hygiene standards for products and for the production, storage, transportation and use of products, labor safety and hygiene standards, and transportation safety standards;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(3) Quality, safety and hygiene standards for engineering construction and other engineering construction standards that the State needs to control;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(4) Pollutant discharge standards and environmental quality standards for environmental protection;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(5) Important general technical terms, symbols, codes and drawing methods;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(6) General test and inspection method standards;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(7) Interchangeability and fit standards;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(8) Quality standards for important products that the State needs to control.文章源自FOFCC-http://fofcc.org.cn/am/11217/
The catalogue of important products that the State needs to control shall be determined by the administrative department for standardization under the State Council together with the relevant competent departments under the State Council.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Standards other than mandatory standards are recommended standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Local standards for safety and health requirements of industrial products formulated by the administrative departments for standardization of provinces, autonomous regions, and municipalities directly under the Central Government are mandatory standards within their respective administrative regions.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 19 In formulating standards, full play shall be given to the role of industry associations, scientific and technological research institutions and academic bodies.文章源自FOFCC-http://fofcc.org.cn/am/11217/
The departments formulating national standards, industry standards and local standards shall organize standardization technical committees composed of experts from users, production units, industry associations, scientific and technological research institutions, academic bodies and relevant departments, which shall be responsible for drafting standards and participating in the technical examination of draft standards. Where no standardization technical committee has been formed, the unit responsible for standardization technology may be responsible for drafting standards and participating in the technical examination of draft standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/
In formulating enterprise standards, the opinions of user units and scientific and technological research institutions shall be fully solicited.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 20 After standards are implemented, the departments formulating the standards shall, in light of the development of science and technology and the needs of economic construction, conduct timely review. Article 21 The measures for the codes and numbering of national standards, industry standards and local standards shall be uniformly prescribed by the administrative department for standardization under the State Council.文章源自FOFCC-http://fofcc.org.cn/am/11217/
The measures for the codes and numbering of enterprise standards shall be prescribed by the administrative department for standardization under the State Council together with the relevant competent departments under the State Council.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 22 The measures for the publication and distribution of standards shall be prescribed by the departments formulating the standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Chapter IV Implementation and Supervision of Standards文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 23 Units and individuals engaged in scientific research, production and business operations must strictly implement mandatory standards. Products that do not conform to mandatory standards shall be prohibited from production, sale and import.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 24 Where an enterprise implements national standards, industry standards, local standards or enterprise standards in production, it shall indicate on the product or its instructions or packaging the code, number and name of the standards implemented.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 25 The technical requirements for export products shall be agreed upon by both parties to the contract.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Where export products are sold domestically and fall within the scope of China's mandatory standards administration, they must conform to the requirements of the mandatory standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 26 In developing new products, improving products and carrying out technological transformation, enterprises shall conform to standardization requirements.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 27 The administrative department for standardization under the State Council shall organize or authorize the relevant competent departments under the State Council to establish industry certification bodies to conduct product quality certification.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 28 The administrative department for standardization under the State Council shall be uniformly responsible for supervising the implementation of standards throughout the country. The administrative departments for standardization of provinces, autonomous regions and municipalities directly under the Central Government shall be uniformly responsible for supervising the implementation of standards within their respective administrative regions. Article 29 The administrative departments for standardization of people's governments at or above the county level may, as needed, establish inspection institutions, or authorize the inspection institutions of other units, to inspect whether products conform to standards and to undertake other supervision and inspection tasks for the implementation of standards. National inspection institutions shall be planned and examined by the administrative department for standardization under the State Council together with the relevant competent departments under the State Council. In handling disputes over whether products conform to standards, the inspection data of the inspection institutions provided for in this Article shall prevail.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 30 The relevant competent departments under the State Council may, as needed and in accordance with relevant State provisions, establish inspection institutions to be responsible for inspection work in their respective industries and departments.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 31 State organs, social organizations, enterprises and institutions and all citizens shall have the right to report and expose acts violating mandatory standards.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Chapter V Legal Liability文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 32 Where the relevant provisions of the Standardization Law and these Regulations are violated and any of the following circumstances exists, the administrative department for standardization or the relevant competent department shall, within the scope of its respective functions and powers, order correction within a time limit, and may circulate a notice of criticism or impose administrative sanctions on the persons responsible:文章源自FOFCC-http://fofcc.org.cn/am/11217/
(1) An enterprise fails to formulate standards as the basis for organizing production as required;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(2) An enterprise fails to report its product standards for the record as required;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(3) An enterprise's products are not marked as required or do not conform to their markings;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(4) Where an enterprise develops new products, improves products, or conducts technological transformation in violation of standardization requirements;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(5) Where, in scientific research, design, or production, the provisions of relevant mandatory standards are violated.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 33 Where products that do not conform to mandatory standards are produced, the producer shall be ordered to stop production, the products shall be confiscated, supervised for destruction or subjected to necessary technical treatment; a fine of 20% to 50% of the value of the batch of products shall be imposed; and the persons responsible shall be fined not more than 5,000 yuan.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Where commodities that do not conform to mandatory standards are sold, the seller shall be ordered to stop selling, and shall be required to recover within a time limit the commodities already sold, supervise their destruction or subject them to necessary technical treatment; the illegal gains shall be confiscated; a fine of 10% to 20% of the value of the batch of commodities shall be imposed; and the persons responsible shall be fined not more than 5,000 yuan.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Where products that do not conform to mandatory standards are imported, the products shall be sealed up and confiscated, supervised for destruction or subjected to necessary technical treatment; a fine of 20% to 50% of the value of the imported products shall be imposed; the persons responsible shall be given administrative sanctions and may also be fined not more than 5,000 yuan.文章源自FOFCC-http://fofcc.org.cn/am/11217/
The order to stop production and administrative sanctions provided for in this Article shall be decided by the relevant competent administrative departments; other administrative penalties shall be decided by the competent department for standardization administration and the administrative department for industry and commerce according to their functions and powers.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 34 Where the production, sale, or import of products that do not conform to mandatory standards causes serious consequences and constitutes a crime, the judicial authorities shall investigate the criminal responsibility of the persons directly responsible according to law.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 35 Where products for which certification certificates have been obtained do not conform to the certification standards but are still sold ex-factory with certification marks, the competent department for standardization administration shall order the sale to be stopped and impose a fine of not more than twice the illegal gains; if the circumstances are serious, the certification department shall revoke the certification certificate.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 36 Where products are sold ex-factory with certification marks without certification or after failing certification, the competent department for standardization administration shall order the sale to be stopped, impose a fine of not more than three times the illegal gains, and impose a fine of not more than 5,000 yuan on the person in charge of the unit.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 23 Where a party is dissatisfied with the penalty of confiscation of products, confiscation of illegal gains, or a fine, it may, within 15 days from the date of receipt of the penalty notice, apply to the authority at the next higher level than the authority that made the penalty decision for reconsideration; where it is dissatisfied with the reconsideration decision, it may, within 15 days from the date of receipt of the reconsideration decision, bring a suit in a people's court. The party may also, within 15 days from the date of receipt of the penalty notice, directly bring a suit in a people's court. Where the party neither applies for reconsideration nor brings a suit in a people's court within the time limit and also fails to perform the penalty decision, the authority that made the penalty decision shall apply to a people's court for compulsory enforcement.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 38 The penalties provided for in Articles 32 to 36 of these Regulations do not exempt the party from liability for damages caused to others. A person who has suffered damage has the right to demand compensation from the responsible person. Disputes over liability for compensation and the amount of compensation may be handled by the relevant competent administrative department, and the parties may also directly bring a suit in a people's court.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 39 Where personnel responsible for the supervision, inspection, and management of standardization work commit any of the following acts, the relevant competent department shall give them administrative sanctions; if a crime is constituted, the judicial authorities shall investigate their criminal responsibility according to law:文章源自FOFCC-http://fofcc.org.cn/am/11217/
(1) Violating the provisions of these Regulations and causing losses due to work errors;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(2) Forging or tampering with inspection data;文章源自FOFCC-http://fofcc.org.cn/am/11217/
(3) Engaging in malpractices for personal gain, abusing power, or soliciting or accepting bribes.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 40 All revenue from fines and confiscations shall be turned over to the treasury. Fines imposed on units shall be paid entirely from their own funds and shall not be included in costs. Fines imposed on responsible persons shall not be written off from public funds.文章源自FOFCC-http://fofcc.org.cn/am/11217/
Chapter VI Supplementary Provisions文章源自FOFCC-http://fofcc.org.cn/am/11217/
Article 41 The regulations on the administration of military standardization shall be formulated separately by the State Council and the Central Military Commission.文章源自FOFCC-http://fofcc.org.cn/am/11217/
