(1) Implement the laws, regulations, guidelines, and policies of the State concerning standardization work, and formulate specific measures for implementation within their respective departments and industries;บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 8 The administrative departments for standardization of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall uniformly manage standardization work within their respective administrative regions and perform the following duties:บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State concerning standardization work, and formulate specific measures for implementation within their respective administrative regions;บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 9 The relevant administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government shall manage, according to division of responsibilities, the standardization work of their respective departments and industries within their respective administrative regions, and perform the following duties:บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State and of their respective departments, industries, and administrative regions concerning standardization work, and formulate specific measures for implementation;บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 10 The division of responsibilities between the administrative departments for standardization and the relevant administrative departments of cities and counties shall be prescribed by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 12 The national standards shall be planned, organized for drafting, uniformly examined and approved, numbered, and issued by the administrative department for standardization under the State Council.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
National standards for engineering construction, pharmaceuticals, food hygiene, veterinary drugs, and environmental protection shall be organized for drafting and examination and approval by the competent departments for engineering construction, health, agriculture, and environmental protection under the State Council respectively; the measures for their numbering and issuance shall be formulated by the administrative department for standardization under the State Council together with the relevant competent administrative departments under the State Council.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 13 For technical requirements for which there are no national standards but which need to be unified within the scope of a certain industry nationwide, industry standards may be formulated (including the preparation of standard samples). Article 14 Industry standards shall be planned, organized for drafting, uniformly examined and approved, numbered, and issued by the relevant competent administrative departments under the State Council, and shall be reported to the administrative department for standardization under the State Council for the record.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 15 For safety and hygiene requirements for industrial products for which there are no national standards and industry standards but which need to be unified within the scope of a province, autonomous region, or municipality directly under the Central Government, local standards may be formulated. Article 16 Local standards shall be planned, organized for drafting, uniformly examined and approved, numbered, and issued by the administrative department for standardization of the people's government of the province, autonomous region, or municipality directly under the Central Government, and shall be reported to the administrative department for standardization under the State Council and the relevant competent administrative departments under the State Council for the record.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 17 Where products produced by an enterprise have no national standards, industry standards, or local standards, corresponding enterprise standards shall be formulated as the basis for organizing production. Article 19 In formulating standards, full play shall be given to the role of industry associations, scientific and technological research institutions, and academic organizations.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Departments formulating national standards, industry standards, and local standards shall organize standardization technical committees composed of experts from users, production units, industry associations, scientific and technological research institutions, academic organizations, and relevant departments, which shall be responsible for drafting standards and participating in the technical review of draft standards. Article 20 After standards are implemented, the departments formulating the standards shall conduct timely review in light of the development of science and technology and the needs of economic construction. Article 23 Units and individuals engaged in scientific research, production, and business operations must strictly implement mandatory standards. Products that do not conform to mandatory standards are prohibited from being produced, sold, and imported.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 24 Where an enterprise implements national standards, industry standards, local standards, or enterprise standards in production, it shall indicate on the product or its instructions or packaging the code, number, and name of the standards implemented.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 25 The technical requirements for export products shall be agreed upon by both parties to the contract.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 27 The administrative department for standardization under the State Council shall organize or authorize the relevant competent administrative departments under the State Council to establish industry certification bodies to carry out product quality certification work.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 28 The administrative department for standardization under the State Council shall be uniformly responsible for supervising the implementation of standards nationwide. The administrative departments for standardization of provinces, autonomous regions, and municipalities directly under the Central Government shall be uniformly responsible for supervising the implementation of standards within their respective administrative regions. Article 29 The administrative departments for standardization of people's governments at or above the county level may, as needed, establish inspection institutions, or authorize the inspection institutions of other units, to inspect whether products conform to standards and to undertake other supervision and inspection tasks for the implementation of standards. National inspection institutions shall be planned and examined by the administrative department for standardization under the State Council together with the relevant competent administrative departments under the State Council. Article 30 The relevant competent administrative departments under the State Council may, in light of needs and relevant State provisions, establish inspection institutions responsible for inspection work in their respective industries and departments.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 31 State organs, public organizations, enterprises, institutions and all citizens shall have the right to report and expose acts violating mandatory standards.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Chapter V Legal LiabilityบทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 32 Where any of the following circumstances occurs in violation of the Standardization Law and the relevant provisions of these Regulations, the competent department of standardization or the relevant competent administrative department shall, within the scope of its functions and powers, order correction within a specified time limit, and may circulate a notice of criticism or impose administrative sanctions on the persons responsible:บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
(1) an enterprise fails to formulate standards as required as the basis for organizing production;บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
(2) an enterprise fails to submit its product standards for the record as required;บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
(3) an enterprise's products are not marked as required or do not conform to their marks;บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
(4) an enterprise's development of new products, improvement of products, or carrying out of technological transformation does not meet standardization requirements;บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 33 Whoever produces products that do not conform to mandatory standards shall be ordered to stop production, and the products shall be confiscated, supervised for destruction or subjected to necessary technical treatment; a fine of 20 percent to 50 percent of the value of the batch of products shall be imposed; and the persons responsible shall be fined not more than 5,000 yuan.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Whoever sells commodities that do not conform to mandatory standards shall be ordered to stop sales, and shall recover the commodities already sold within a specified time limit, supervise their destruction or subject them to necessary technical treatment; the illegal gains shall be confiscated; a fine of 10 percent to 20 percent of the value of the batch of commodities shall be imposed; and the persons responsible shall be fined not more than 5,000 yuan.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Whoever imports products that do not conform to mandatory standards shall have the products sealed up and confiscated, supervised for destruction or subjected to necessary technical treatment; a fine of 20 percent to 50 percent of the value of the imported products shall be imposed; the persons responsible shall be given administrative sanctions and may also be fined not more than 5,000 yuan.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
The order to stop production and administrative sanctions provided for in this Article shall be decided by the relevant competent administrative department; other administrative penalties shall be decided by the competent department of standardization and the administrative department for industry and commerce according to their functions and powers.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 34 Where the production, sale, or import of products that do not conform to mandatory standards causes serious consequences and constitutes a crime, the judicial organs shall investigate the criminal liability of the persons directly responsible according to law.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 35 Where products that have obtained certification certificates do not conform to the certification standards but are still sold ex-factory with certification marks, the competent department of standardization shall order the cessation of sales and impose a fine of not more than twice the illegal gains; if the circumstances are serious, the certification department shall revoke the certification certificate.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 36 Where products are sold ex-factory with certification marks without certification or after failing certification, the competent department of standardization shall order the cessation of sales, impose a fine of not more than three times the illegal gains, and impose a fine of not more than 5,000 yuan on the person in charge of the unit.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 37 If a party is dissatisfied with the penalty of confiscation of products, confiscation of illegal gains, or a fine, it may, within 15 days from the date of receipt of the penalty notice, apply to the authority at the next higher level of the authority that made the penalty decision for reconsideration; if it is dissatisfied with the reconsideration decision, it may, within 15 days from the date of receipt of the reconsideration decision, bring a suit before a people's court. The party may also, within 15 days from the date of receipt of the penalty notice, directly bring a suit before a people's court. If the party neither applies for reconsideration nor brings a suit before a people's court within the time limit, and also fails to perform the penalty decision, the authority that made the penalty decision shall apply to a people's court for compulsory enforcement.บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/
Article 38 The penalties provided for in Articles 32 to 36 of these Regulations shall not exempt the resulting liability for compensation for damage to others. A person who has suffered damage shall have the right to demand compensation from the person responsible. Article 39 If any person engaged in the supervision, inspection, or management of standardization work commits any of the following acts, the relevant competent department shall impose administrative sanctions on him; if a crime is constituted, the judicial organs shall investigate his criminal liability according to law:บทความมาจากFOFCC-http://fofcc.org.cn/th/11217/

Article 40 All revenues from fines and confiscations shall be turned over to the treasury. Fines imposed on units shall be paid entirely from their own funds and shall not be included in costs.
