Article 1 These Regulations are formulated in accordance with the provisions of the Standardization Law of the People's Republic of China (hereinafter referred to as the Standardization Law).Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

(2) Methods for the design, production, inspection, packaging, storage, transportation, and use of industrial products, or safety and sanitary requirements in the processes of production, storage, and transportation.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(3) Various technical requirements and inspection methods relating to environmental protection.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

Article 3 The State shall develop standardization undertakings in a planned manner. Standardization work shall be incorporated into national economic and social development plans at all levels.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 4 The State encourages the adoption of international standards and advanced foreign standards and actively participates in the formulation of international standards.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Chapter II Management of Standardization WorkArtikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 3 The tasks of standardization work are to formulate standards, organize the implementation of standards, and supervise the implementation of standards.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 6 The administrative department for standardization under the State Council shall uniformly manage standardization work throughout the country and perform the following duties:Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(1) Organize the implementation of laws, regulations, guidelines, and policies of the State concerning standardization work;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(2) Organize the formulation of national standardization work plans and programs;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

Article 7 The relevant administrative departments under the State Council shall manage, according to division of responsibilities, the standardization work of their respective departments and industries and perform the following duties:Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State concerning standardization work, and formulate specific measures for implementation within their respective departments and industries;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(2) Formulate standardization work plans and programs for their respective departments and industries;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(3) Undertake the task assigned by the State of drafting national standards and organize the formulation of industry standards;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(4) Guide the standardization work of the relevant administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(5) Organize the implementation of standards within their respective departments and industries;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

(7) With authorization from the administrative department for standardization under the State Council, manage, according to division of responsibilities, product quality certification work in their respective industries.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 8 The administrative departments for standardization of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall uniformly manage standardization work within their respective administrative regions and perform the following duties:Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State concerning standardization work, and formulate specific measures for implementation within their respective administrative regions;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(2) Formulate local standardization work plans and programs;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

(4) Guide the standardization work of the relevant administrative departments within their respective administrative regions, and coordinate and handle issues concerning standardization work;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

Article 9 The relevant administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government shall manage, according to division of responsibilities, the standardization work of their respective departments and industries within their respective administrative regions and perform the following duties:Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(1) Implement the laws, regulations, guidelines, and policies of the State and of their respective departments, industries, and administrative regions concerning standardization work, and formulate specific measures for implementation;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(2) Formulate standardization work plans and programs for their respective departments and industries within their respective administrative regions;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(3) Undertake the task assigned by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government of drafting local standards;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(4) Organize the implementation of standards by their respective departments and industries within their respective administrative regions;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

Article 10 The division of responsibilities between the administrative departments for standardization and the relevant administrative departments of cities and counties shall be prescribed by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Chapter III Formulation of StandardsArtikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 11 National standards (including the preparation of standard samples) shall be formulated for the following technical requirements that need to be unified nationwide:Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(1) Requirements for interchangeability and compatibility and general technical language;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(2) Technical requirements for safeguarding human health and the safety of persons and property;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(3) Technical requirements for basic raw materials, fuels, and materials;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(4) Technical requirements for general-purpose basic parts;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(5) General test and inspection methods;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

Article 12 National standards shall be planned, organized for drafting, uniformly examined and approved, numbered, and promulgated by the administrative department for standardization under the State Council.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
For national standards on engineering construction, pharmaceuticals, food hygiene, veterinary drugs, and environmental protection, the competent departments for engineering construction, health, agriculture, and environmental protection under the State Council shall respectively organize the drafting and examination and approval; the measures for numbering and promulgation shall be formulated by the administrative department for standardization under the State Council together with the relevant competent administrative departments under the State Council.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

Article 13 For technical requirements for which no national standards exist but which need to be unified within a certain industry nationwide, industry standards may be formulated (including the preparation of standard samples). Article 14 Industry standards shall be planned, organized for drafting, uniformly examined and approved, numbered, and promulgated by the relevant competent administrative departments under the State Council, and shall be filed with the administrative department for standardization under the State Council.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Industry standards shall automatically become invalid after the corresponding national standards are implemented.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 15 For safety and hygiene requirements for industrial products for which no national standards or industry standards exist but which need to be unified within the scope of a province, autonomous region, or municipality directly under the Central Government, local standards may be formulated. Article 16 Local standards shall be planned, organized for drafting, uniformly examined and approved, numbered, and promulgated by the administrative department for standardization of the people's government of the province, autonomous region, or municipality directly under the Central Government, and shall be filed with the administrative department for standardization under the State Council and the relevant competent administrative departments under the State Council.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

Article 17 Where products manufactured by an enterprise have no national standards, industry standards, or local standards, corresponding enterprise standards shall be formulated as the basis for organizing production. Enterprise standards shall be formulated by the enterprise itself (measures for formulating agricultural enterprise standards shall be separately prescribed), and shall be filed in accordance with the provisions of the people's government of the province, autonomous region, or municipality directly under the Central Government.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Where national standards, industry standards, or local standards already exist, enterprises are encouraged to formulate enterprise standards stricter than the requirements of the national standards, industry standards, or local standards, for application within the enterprise.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 18 National standards and industry standards are divided into mandatory standards and recommended standards.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/

(1) Pharmaceutical standards, food hygiene standards, and veterinary drug standards;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(2) Safety and hygiene standards for products and for product production, storage, transportation, and use, labor safety and hygiene standards, and transportation safety standards;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(3) Quality, safety, and hygiene standards for engineering construction and other engineering construction standards that the State needs to control;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(4) Pollutant discharge standards and environmental quality standards for environmental protection;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(5) Important general technical terms, symbols, codes, and drawing methods;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(6) General test and inspection method standards;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(7) Interchangeability and fit standards;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(8) Quality standards for important products that the State needs to control.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
The catalogue of important products that the State needs to control shall be determined by the administrative department for standardization under the State Council together with the relevant competent administrative departments under the State Council.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Standards other than mandatory standards are recommended standards.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Local standards for the safety and sanitary requirements of industrial products formulated by the administrative departments in charge of standardization of provinces, autonomous regions, and municipalities directly under the Central Government are mandatory standards within their respective administrative regions.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 19 In formulating standards, the role of industry associations, scientific and technological research institutions, and academic organizations shall be brought into play.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Departments formulating national standards, industry standards, and local standards shall organize standardization technical committees composed of experts from users, production units, industry associations, scientific and technological research institutions, academic organizations, and relevant departments to be responsible for drafting standards and participating in the technical review of draft standards. In formulating enterprise standards, the opinions of user units and scientific and technological research institutions shall be fully solicited.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 20 After standards are implemented, the departments formulating the standards shall, in light of the development of science and technology and the needs of economic construction, conduct timely reviews. Article 21 The measures for the codes and numbering of national standards, industry standards, and local standards shall be uniformly prescribed by the administrative department for standardization under the State Council.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
The measures for the codes and numbering of enterprise standards shall be prescribed by the administrative department for standardization under the State Council together with the relevant competent administrative departments under the State Council.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 22 The measures for the publication and distribution of standards shall be prescribed by the departments formulating the standards.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Chapter IV Implementation and Supervision of StandardsArtikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 23 Units and individuals engaged in scientific research, production, and business operations must strictly implement mandatory standards. Products that do not conform to mandatory standards are prohibited from being produced, sold, and imported.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 24 Where an enterprise implements national standards, industry standards, local standards, or enterprise standards in production, it shall indicate on the product or its instructions or packaging the code, number, and name of the standards implemented.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 25 The technical requirements for export products shall be agreed upon by both parties to the contract.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Where export products are sold domestically and fall within the scope of China's mandatory standard management, they must conform to the requirements of the mandatory standards.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 26 Enterprises developing new products, improving products, and conducting technological transformation shall conform to standardization requirements.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 27 The administrative department for standardization under the State Council shall organize or authorize the relevant competent administrative departments under the State Council to establish industry certification bodies to conduct product quality certification work.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 28 The administrative department for standardization under the State Council shall be uniformly responsible for the supervision of the implementation of standards nationwide. The administrative departments for standardization of provinces, autonomous regions, and municipalities directly under the Central Government shall be uniformly responsible for the supervision of the implementation of standards within their respective administrative regions. The relevant competent administrative departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible, according to division of duties, for the supervision of the implementation of standards in their respective departments and industries within their respective administrative regions.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
The administrative departments for standardization and the relevant competent administrative departments of cities and counties shall, in accordance with their respective duties as prescribed by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, be responsible for the supervision of the implementation of standards within their respective administrative regions.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 29 The administrative departments for standardization of people's governments at or above the county level may, as needed, establish inspection institutions, or authorize the inspection institutions of other units, to inspect whether products conform to standards and to undertake other supervision and inspection tasks for the implementation of standards. National inspection institutions shall be planned and examined by the administrative department for standardization under the State Council together with the relevant competent administrative departments under the State Council. In handling disputes over whether products conform to standards, the inspection data of the inspection institutions provided for in this Article shall prevail.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 30 The relevant competent administrative departments under the State Council may, as needed and in accordance with relevant State provisions, establish inspection institutions to be responsible for inspection work in their respective industries and departments.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 31 State organs, social organizations, enterprises and institutions, and all citizens have the right to report and expose acts violating mandatory standards.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Chapter V Legal LiabilityArtikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 32 Where the relevant provisions of the Standardization Law and these Regulations are violated and any of the following circumstances exists, the administrative department for standardization or the relevant competent administrative department shall, within the scope of its respective functions and powers, order correction within a time limit, and may circulate a notice of criticism or impose administrative sanctions on the persons responsible:Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(1) An enterprise fails to formulate standards as the basis for organizing production as required;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(2) An enterprise fails to submit its product standards for filing as required;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(3) An enterprise's products are not accompanied by marks as required or do not conform to their marks;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(4) An enterprise develops new products, improves products, or conducts technological transformation in a manner that does not conform to standardization requirements;Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
(5) Violating relevant mandatory standards in scientific research, design, or production.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 33 If products do not conform to mandatory standards, the producer shall be ordered to stop production, the products shall be confiscated, and they shall be supervised for destruction or subjected to necessary technical handling; a fine of 20% to 50% of the value of the batch of products shall be imposed; and the persons responsible shall be fined not more than 5,000 yuan.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
If commodities that do not conform to mandatory standards are sold, the seller shall be ordered to stop selling them, and shall be required to recover within a time limit the commodities already sold, and the commodities shall be supervised for destruction or subjected to necessary technical handling; the illegal gains shall be confiscated; a fine of 10% to 20% of the value of the batch of commodities shall be imposed; and the persons responsible shall be fined not more than 5,000 yuan.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
If products that do not conform to mandatory standards are imported, the products shall be sealed up and confiscated, and shall be supervised for destruction or subjected to necessary technical handling; a fine of 20% to 50% of the value of the imported products shall be imposed; the persons responsible shall be given administrative sanctions and may also be fined not more than 5,000 yuan.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
The order to stop production and administrative sanctions provided for in this Article shall be decided by the relevant competent administrative departments; other administrative penalties shall be decided by the competent department for standardization and the administrative department for industry and commerce according to their functions and powers.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 34 If the production, sale, or import of products that do not conform to mandatory standards causes serious consequences and constitutes a crime, the judicial authorities shall investigate the criminal responsibility of the persons directly responsible according to law.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 35 If products for which certification certificates have been obtained do not conform to the certification standards but are still sold ex-factory with the certification mark, the competent department for standardization shall order the sale to be stopped and impose a fine of not more than twice the illegal gains; if the circumstances are serious, the certification department shall revoke the certification certificate.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 36 If products are sold ex-factory with the certification mark without certification or after failing certification, the competent department for standardization shall order the sale to be stopped, impose a fine of not more than three times the illegal gains, and impose a fine of not more than 5,000 yuan on the person in charge of the unit.Artikel berasal dariFOFCC-http://fofcc.org.cn/ms/11217/
Article 23 Where a party is dissatisfied with the penalty of confiscation of products, confiscation of illegal gains, or a fine, it may, within 15 days from the date of receiving the penalty notice, apply to the authority at the next higher level than the authority that made the penalty decision for reconsideration; where it is dissatisfied with the reconsideration decision, it may, within 15 days from the date of receiving the reconsideration decision, bring a suit in a people's court. The party may also, within 15 days from the date of receiving the penalty notice, directly bring a suit in a people's court. Article 38 The penalties provided for in Articles 32 to 36 of these Regulations do not exempt the resulting liability for damages to others. A person who has suffered damage has the right to demand compensation for losses from the responsible person. Article 40 All revenue from fines and confiscations shall be turned over to the treasury. Fines imposed on units shall be paid entirely from their own funds and shall not be included in costs.
