Article 1 These Regulations are formulated in accordance with the Standardisation Law of the People's Republic of China (hereinafter referred to as the Standardisation Law).文章源自FOFCC-http://fofcc.org.cn/en/11217/

(2) Methods for the design, production, inspection, packaging, storage, transportation, or use of industrial products, or safety and hygiene requirements in the processes of production, storage, and transportation.文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) Various technical requirements and test methods related to environmental protection.文章源自FOFCC-http://fofcc.org.cn/en/11217/

Article 3 The State shall develop the standardisation undertakings in a planned manner. Standardisation work shall be incorporated into the national economic and social development plans at all levels.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 4 The State encourages the adoption of international standards and advanced foreign standards, and actively participates in the formulation of international standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Chapter 2 Management of Standardisation Work文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 3 The tasks of standardisation work are to formulate standards, organise the implementation of standards, and supervise the implementation of standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 6 The administrative department for standardisation under the State Council shall uniformly manage standardisation work across the country and perform the following duties:文章源自FOFCC-http://fofcc.org.cn/en/11217/
(1) Organise and implement laws, regulations, guidelines, and policies concerning standardisation work from the state;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) Organise the formulation of national standardisation work programmes and plans;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) organise the formulation of national standards;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(4) To guide the standardization work of the relevant administrative departments under the State Council and the administrative departments for standardization of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, and to coordinate and resolve issues concerning standardization work;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(5) Organising and implementing standards;文章源自FOFCC-http://fofcc.org.cn/en/11217/

Article 7 The relevant administrative departments of the State Council shall, in accordance with their respective divisions of responsibility, manage the standardisation work within their respective departments and industries, and perform the following duties:文章源自FOFCC-http://fofcc.org.cn/en/11217/
(1) Implement laws, regulations, guidelines and policies concerning national standardisation work, and formulate specific measures for implementation within this department and industry;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) To formulate standardisation work programmes and plans for its own department and industry;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) Undertake tasks assigned by the state to draft national standards, and organise the formulation of industry standards;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(4) to guide the standardisation work of the relevant administrative departments in provinces, autonomous regions and municipalities directly under the Central Government;文章源自FOFCC-http://fofcc.org.cn/en/11217/

Article 8 The administrative departments for standardisation of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall uniformly manage the standardisation work within their respective administrative areas and perform the following duties:文章源自FOFCC-http://fofcc.org.cn/en/11217/
(1) to implement the laws, regulations, guidelines and policies of the state concerning standardization work, and to formulate specific measures for implementation within this administrative area;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) formulating local standardisation work plans and programmes;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) Organise the formulation of local standards;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(4) guiding the standardisation work of the relevant administrative authorities in this administrative region, and coordinating and addressing issues related to standardisation work;文章源自FOFCC-http://fofcc.org.cn/en/11217/

Article 9 The relevant administrative authorities of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with the division of responsibilities, manage the standardisation work within their respective administrative areas and for their respective departments and industries, and shall perform the following duties:文章源自FOFCC-http://fofcc.org.cn/en/11217/
(1) To implement laws, regulations, guidelines, and policies regarding standardization work at the national, departmental, industrial, and administrative regional levels, and to formulate specific measures for their implementation;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) Formulate standardisation work programnes and plans for its own department and industry within this administrative region;文章源自FOFCC-http://fofcc.org.cn/en/11217/

Article 10 The division of responsibilities between municipal and county administrative departments for standardisation and other relevant administrative departments shall be stipulated by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Chapter 3 Development of Standards文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 11. National standards (including the production of standard samples) shall be formulated for the following technical requirements that need to be unified nationwide:文章源自FOFCC-http://fofcc.org.cn/en/11217/
(1) Interchangeable fits and general technical language requirements;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) Technical requirements for safeguarding human health and personal and property safety;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) Technical requirements for basic raw materials, fuel and materials;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(4) Technical requirements for general basic components;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(5) general testing and inspection methods;文章源自FOFCC-http://fofcc.org.cn/en/11217/

Article 12 National standards shall be planned, drafted, uniformly approved, numbered and published by the administrative department for standardisation under the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
National standards for engineering construction, pharmaceuticals, food hygiene, veterinary drugs, and environmental protection shall be respectively drafted and approved by the competent departments for engineering construction, health, agriculture, and environmental protection under the State Council; their numbering and publication methods shall be formulated by the administrative department for standardization under the State Council jointly with the relevant administrative departments under the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Where the law provides otherwise in respect of the formulation of standards, those provisions shall apply.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 13. For technical requirements that lack a national standard but need to be unified within a certain industry nationwide, industry standards (including the production of standard samples) may be formulated. Projects for the formulation of industry standards shall be determined by the relevant administrative departments of the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 14. Industry standards shall have their plans formulated, drafting organised, and approval, numbering and release unified by the relevant administrative departments under the State Council, and shall be filed with the administrative department for standardization under the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Industry standards shall be automatically annulled upon the implementation of the corresponding national standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 15 Local standards may be formulated for safety and hygienic requirements for industrial products for which there are no national standards or sector standards, but which need to be unified within the scope of a province, autonomous region, or municipality directly under the Central Government. Article 16 Local standards shall be planned, drafted, uniformly approved, numbered and released by the standardization administrative department of the government of the province, autonomous region or municipality directly under the Central Government, and shall be filed with the standardization administrative department of the State Council and the relevant administrative departments of the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Where the law provides otherwise in respect of the formulation of standards, those provisions shall apply.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Local standards shall automatically be revoked once the corresponding national standards or industry standards come into effect.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 17 Where an enterprise manufactures products for which there are no national standards, industry standards, or local standards, it shall formulate corresponding enterprise standards to serve as the basis for organising production. Enterprise standards shall be formulated by the enterprises themselves (procedures for formulating agricultural enterprise standards shall be prescribed separately) and shall be filed in accordance with the provisions of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Where national standards, industry standards or local standards already exist, enterprises are encouraged to formulate enterprise standards that are stricter than the requirements of the national standards, industry standards or local standards, for application within the enterprise.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 18 National standards and industry standards are divided into mandatory standards and recommended standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/

(1) Pharmaceutical standards, food hygiene standards, veterinary drug standards;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) Safety and health standards for products and their production, storage, transportation, and use; occupational safety and health standards; and transportation safety standards;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) Quality, safety and health standards for engineering construction, and other engineering construction standards that need to be controlled by the State;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(iv) pollutant emission standards and environmental quality standards for environmental protection;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(v) important general technical terminology, symbols, codes, and drafting methods;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(6) General test and inspection method standards;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(7) Standards for interchangeability and fits;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(8) Quality standards for important products that require state control.文章源自FOFCC-http://fofcc.org.cn/en/11217/
The catalogue of important products that require state control shall be determined by the administrative department for standardisation under the State Council together with the relevant administrative departments under the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Standards other than mandatory standards are voluntary standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Local standards for the safety and hygiene requirements of industrial products formulated by the administrative departments for standardisation of provinces, autonomous regions, and municipalities directly under the Central Government shall be mandatory standards within their respective administrative areas.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 19 In formulating standards, the roles of industry associations, scientific and technological research institutions, and academic organisations shall be given full play.文章源自FOFCC-http://fofcc.org.cn/en/11217/
The departments responsible for formulating national standards, industry standards, and local standards shall organise a standardisation technical committee composed of experts from users, production units, industry associations, scientific and technological research institutions, academic organisations, and relevant departments, which shall be responsible for the drafting of standards and participating in the technical review of draft standards. Where a standardisation technical committee has not been established, a standardisation technical focal point unit may be responsible for the drafting of standards and participating in the technical review of draft standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
The formulation of enterprise standards shall fully solicit the opinions of user units and scientific and technological research institutions.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 20 After a standard has been implemented, the department that formulated the standard shall conduct a review in a timely manner in accordance with the development of science and technology and the needs of economic construction. Article 21 The methods for designating codes and serial numbers for national standards, industry standards and local standards shall be uniformly prescribed by the administrative department for standardization under the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
The designation and numbering methods for enterprise standards shall be prescribed by the administrative department for standardization under the State Council in conjunction with the relevant administrative departments under the State Council.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 22 Methods for the publication and distribution of standards shall be stipulated by the departments that formulate the standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Chapter 4 Implementation and Supervision of Standards文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 23 Units and individuals engaged in scientific research, production, and business operations must strictly implement mandatory standards. The production, sale, and import of products that do not conform to mandatory standards are prohibited.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 24: Where an enterprise produces goods in accordance with national standards, industry standards, local standards, or enterprise standards, it shall indicate the code, number, and name of the applied standards on the product, its instructions, or its packaging.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 25. The technical requirements for exported products shall be agreed upon by both parties to the contract.文章源自FOFCC-http://fofcc.org.cn/en/11217/
When export products are sold domestically, if they fall within the scope of our country's mandatory standards management, they must comply with the requirements of the mandatory standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 26 Enterprises developing new products, improving products, or carrying out technological transformations shall comply with standardisation requirements.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 27 The administrative department for standardization under the State Council shall organise or authorise the relevant administrative departments under the State Council to establish industry certification bodies to carry out product quality certification work.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 28 The administrative department for standardization under the State Council shall be uniformly responsible for the supervision of the implementation of standards nationwide. The administrative departments for standardisation of provinces, autonomous regions and municipalities directly under the Central Government shall uniformly be responsible for the supervision of the implementation of standards within their respective administrative areas. Municipal and county standardization administrative authorities and relevant administrative authorities shall, in accordance with their respective duties prescribed by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, be responsible for supervising the implementation of standards within their respective administrative areas.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 29 The administrative departments for standardisation of people's governments at or above county level may, as required, establish inspection institutions or authorise inspection institutions of other units to inspect whether products conform to standards and to undertake tasks relating to supervisory inspection for the implementation of other standards. National inspection agencies shall be planned and reviewed by the administrative department for standardisation under the State Council together with the relevant administrative departments under the State Council. Local inspection agencies shall be planned and reviewed by the administrative departments for standardisation of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government together with the relevant provincial administrative departments.文章源自FOFCC-http://fofcc.org.cn/en/11217/
In handling disputes concerning whether a product complies with standards, the inspection data provided by the inspection institution specified in this Article shall prevail.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 30 The relevant administrative departments of the State Council may, in accordance with needs and relevant state provisions, establish inspection institutions responsible for inspection work within their respective industries and departments.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 31 State organs, social organisations, enterprises, institutions and all citizens shall have the right to report and expose acts that violate mandatory standards.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Chapter 5 Legal Liability文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 32. Anyone who violates the relevant provisions of the Standardisation Law and these Regulations under any of the following circumstances shall be ordered by the administrative department for standardisation or other relevant administrative departments within their respective statutory powers to make improvements within a prescribed time limit, and may be circulated for criticism or have administrative sanctions imposed on the persons responsible:文章源自FOFCC-http://fofcc.org.cn/en/11217/
(1) Where an enterprise fails to formulate standards in accordance with regulations as the basis for organising production;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) Where an enterprise fails to submit its product standards for filing in accordance with the prescribed requirements;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) Where an enterprise's products are not accompanied by labels as required or do not correspond to their labels;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(iv) where an enterprise develops new products, improves products, or carries out technical transformation that fails to meet standardisation requirements;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(5) Violating the provisions of relevant mandatory standards in scientific research, design, or production.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 33. Anyone who produces products that fail to comply with mandatory standards shall be ordered to cease production, and the products shall be confiscated, supervised for destruction, or subjected to necessary technical treatment. A fine of 20% to 50% of the value of the batch of products shall be imposed, and a fine of up to 5,000 yuan shall be imposed on the person(s) directly responsible.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Where goods that fail to comply with mandatory standards are sold, [the offender] shall be ordered to cease the sale, recover the goods already sold within a prescribed time limit, and supervise their destruction or necessary technical treatment; the illegal gains shall be confiscated; a fine of ten per cent to twenty per cent of the value of the batch of goods shall be imposed; and a fine of not more than five thousand yuan shall be imposed on the persons directly responsible.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Anyone importing products that fail to comply with mandatory standards shall have such products sealed and confiscated, and be supervised in destroying them or carrying out necessary technical treatment; a fine of 20 per cent to 50 per cent of the value of the imported products shall be imposed; administrative sanctions shall be imposed on the persons directly responsible, and a fine of up to 5,000 yuan may also be imposed.文章源自FOFCC-http://fofcc.org.cn/en/11217/
The orders to cease production and the administrative penalties stipulated in this Article shall be decided by the relevant administrative authorities in charge; other administrative penalties shall be decided by the administrative authorities in charge of standardization and the administrative departments for industry and commerce in accordance with their respective powers.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 34 Where the production, sale, or import of products that do not comply with mandatory standards results in serious consequences and constitutes a crime, the judicial authorities shall investigate the criminal liability of the persons directly in charge and other directly responsible personnel in accordance with the law.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 35 Where products that have obtained certificate fail to meet certification standards yet are still sold with the certification mark, the administrative department for standardization shall order them to stop selling and impose a fine of not more than twice the illegal gains; if the circumstances are serious, the certification authority shall revoke their certificate.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 36 Where products that have not been certified or have failed certification are unauthorisedly labelled with certification marks and dispatched from the factory for sale, the administrative department for standardisation shall order the cessation of sales, impose a fine of not more than three times the illegal gains, and impose a fine of not more than 5,000 yuan on the person in charge of the unit.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 23 Where a party is dissatisfied with the penalties of confiscation of products, confiscation of illegal gains, and fines, it may, within 15 days from the date of receiving the penalty notice, apply for review to the authority superior to the one that made the penalty decision; if it is dissatisfied with the review decision, it may, within 15 days from the date of receiving the review decision, bring a lawsuit in a people's court. A party may also, within 15 days from the date of receiving the penalty notice, directly bring a lawsuit in a people's court. If a party neither applies for review nor brings a lawsuit in a people's court upon the expiration of the time limit, nor complies with the penalty decision, the authority that made the penalty decision shall apply to a people's court for compulsory enforcement.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 38 The penalties provided for in Articles 32 to 36 of these Regulations shall not exempt the offender from the civil liability for damages caused to others. Those who suffer damage have the right to demand compensation for losses from the responsible party. Disputes concerning liability and the amount of compensation may be handled by the relevant competent administrative departments, or the parties may directly bring a lawsuit in a people's court.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 39 Where supervision, inspection, or management personnel for standardisation work commit any of the following acts, administrative sanctions shall be imposed by the relevant competent authorities; where a crime is constituted, criminal responsibility shall be pursued by the judicial organs in accordance with the law:文章源自FOFCC-http://fofcc.org.cn/en/11217/
(1) where, in violation of the provisions of these Regulations, operational errors result in losses;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(2) Falsifying or tampering with testing data;文章源自FOFCC-http://fofcc.org.cn/en/11217/
(3) practicing favouritism and embezzlement, abusing power, or soliciting and accepting bribes.文章源自FOFCC-http://fofcc.org.cn/en/11217/
Article 40 All confiscations and fine revenues shall be turned over in full to the state treasury. Fines imposed on an organization shall be paid entirely out of its own funds and shall not be included in costs. Fines imposed on the responsible persons shall not be written off using public funds.文章源自FOFCC-http://fofcc.org.cn/en/11217/
