Article 1 These Measures are formulated in accordance with the Law of the People's Republic of China on the Quality and Safety of Agricultural Products for the purposes of regulating the production and operation activities of agricultural products, strengthening the administration of the packaging and labeling of agricultural products, establishing and improving the traceability system for agricultural products, and ensuring the quality and safety of agricultural products.文章源自FOFCC-http://fofcc.org.cn/am/11225/

Article 3 The Ministry of Agriculture shall be responsible for the supervision and administration of the packaging and labeling of agricultural products nationwide.文章源自FOFCC-http://fofcc.org.cn/am/11225/
The competent agricultural administrative departments of the local people's governments at or above the county level shall be responsible for the supervision and administration of the packaging and labeling of agricultural products within their respective administrative regions.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 4 The State shall support scientific research on the packaging and labeling of agricultural products, promote scientific packaging methods, and popularize advanced labeling technologies.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 5 The competent agricultural administrative departments of the people's governments at or above the county level shall incorporate the funds for the administration of the packaging and labeling of agricultural products into their annual budgets.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 6 The competent agricultural administrative departments of the people's governments at or above the county level shall commend and reward units and individuals that have made outstanding contributions to the packaging and labeling of agricultural products.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Chapter II Packaging of Agricultural Products文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 7 The following agricultural products used for sale by agricultural product production enterprises, specialized farmers' cooperative economic organizations, and units or individuals engaged in the purchase of agricultural products must be packaged:文章源自FOFCC-http://fofcc.org.cn/am/11225/
(1) Agricultural products that have obtained certification such as pollution-free agricultural products, green food, and organic agricultural products, except for fresh livestock, poultry, and aquatic products.文章源自FOFCC-http://fofcc.org.cn/am/11225/
(2) Other agricultural products that need to be packaged for sale as prescribed by the competent agricultural administrative departments of the people's governments at or above the provincial level.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Agricultural products that comply with the prescribed packaging and are sold directly to consumers after being unpacked may no longer be separately packaged.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 8 The packaging of agricultural products shall meet the requirements of storage, transportation, sale, and safety assurance of agricultural products, and shall be convenient for disassembly and handling.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 9 The materials used for packaging agricultural products and the substances used such as preservatives, anti-corrosion agents, and additives must comply with the requirements of national mandatory technical specifications.文章源自FOFCC-http://fofcc.org.cn/am/11225/
The packaging of agricultural products shall prevent mechanical damage and secondary contamination.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Chapter III Labeling of Agricultural Products文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 10 For agricultural products packaged for sale by agricultural product production enterprises, specialized farmers' cooperative economic organizations, and units or individuals engaged in the purchase of agricultural products, the product name, place of origin, name of the producer or seller, and production date shall be marked on the packaging or attached with a label.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Where there are grading standards or additives are used, the product quality grade or the names of the additives shall also be indicated.文章源自FOFCC-http://fofcc.org.cn/am/11225/
For unpackaged agricultural products, the product name, place of production, name of the producer or seller, and other relevant information shall be indicated in the form of attached labels, marking plates, marking tapes, instruction sheets, or other forms.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 11 The text used in the labeling of agricultural products shall be standard Chinese. The content of the label shall be accurate, clear, and conspicuous.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 12 For the sale of agricultural products that have obtained the right to use quality marks such as pollution-free agricultural products, green food, and organic agricultural products, the corresponding marks and the certification bodies shall be indicated.文章源自FOFCC-http://fofcc.org.cn/am/11225/
It is prohibited to fraudulently use quality marks such as those for pollution-free agricultural products, green food, and organic agricultural products.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 13 Livestock and poultry and their products, and agricultural products that are agricultural genetically modified organisms shall also be labeled in accordance with relevant provisions.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Chapter IV Supervision and Inspection文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 14 Agricultural product production enterprises, specialized farmers' cooperative economic organizations, and units or individuals engaged in the purchase of agricultural products shall be responsible for the packaging quality and labeling content of the agricultural products they sell.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 15 The competent agricultural administrative departments of the people's governments at or above the county level shall conduct supervision and inspection of the packaging and labeling of agricultural products in accordance with the Law of the People's Republic of China on the Quality and Safety of Agricultural Products.文章源自FOFCC-http://fofcc.org.cn/am/11225/
Article 16 Under any of the following circumstances, the competent agricultural administrative departments of the people's governments at or above the county level shall handle and penalize in accordance with the provisions of Articles 48, 49, 51, and 52 of the Law of the People's Republic of China on the Quality and Safety of Agricultural Products:文章源自FOFCC-http://fofcc.org.cn/am/11225/
(1) The packaging materials used for agricultural products do not comply with the requirements of mandatory technical specifications;文章源自FOFCC-http://fofcc.org.cn/am/11225/
(2) The materials used in the packaging process of agricultural products, such as preservatives, anti-corrosion agents, and additives, do not comply with the requirements of mandatory technical specifications;文章源自FOFCC-http://fofcc.org.cn/am/11225/

Chapter V Supplementary Provisions文章源自FOFCC-http://fofcc.org.cn/am/11225/

(1) Packaging of agricultural products: refers to boxing, cartoning, bagging, wrapping, bundling, etc. of agricultural products.文章源自FOFCC-http://fofcc.org.cn/am/11225/
(2) Preservatives: refers to artificially synthesized chemical substances or natural substances that maintain the fresh quality of agricultural products, reduce circulation losses, and extend storage time.文章源自FOFCC-http://fofcc.org.cn/am/11225/
(3) Anti-corrosion agents: refers to artificially synthesized chemical substances or natural substances that prevent agricultural products from rotting and deteriorating.文章源自FOFCC-http://fofcc.org.cn/am/11225/
(4) Additives: refers to artificially synthesized chemical substances or natural substances added to improve the quality, color, aroma, taste, and processing performance of agricultural products.文章源自FOFCC-http://fofcc.org.cn/am/11225/
(5) Production date: for plant products, it refers to the date of harvest; for livestock and poultry products, it refers to the date of slaughter or production; for aquatic products, it refers to the date of capture; for other products, it refers to the date of packaging or sale.文章源自FOFCC-http://fofcc.org.cn/am/11225/
