Article 34 The State establishes an agricultural product quality and safety monitoring system. The competent agricultural administrative departments of the people's governments at or above the county level shall, in accordance with the requirements for safeguarding agricultural product quality and safety, formulate and organize the implementation of agricultural product quality and safety monitoring plans, and conduct supervisory spot checks on agricultural products in production or sold on the market. Supervisory spot check testing shall be entrusted to agricultural product quality and safety testing institutions that meet the conditions specified in Article 35 of this Law. No fees shall be charged to the persons subject to spot checks, and the number of samples taken shall not exceed the amount prescribed by the competent agricultural administrative department of the State Council.
