To all directly affiliated inspection and quarantine bureaus, quality and technical supervision bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government, the China National Accreditation Service for Conformity Assessment, and the Certification and Accreditation Research Institute:
In accordance with the annual work plan of the Certification and Accreditation Administration of the People's Republic of China (CNCA) and the "Notice of the CNCA on Issuing the 2014 Special Supervision and Inspection Plan for Certification and Accreditation" (Guo Ren Fa [2014] No. 23), the relevant work arrangements for the special supervision and inspection of food and agricultural product certification are hereby notified as follows:
I. Key Areas of the Special Supervision and Inspection
Based on risk analysis of the results of special supervision and inspections of food and agricultural product certification in recent years, routine supervision results from various localities, handling of complaints and appeals, proposals from the National People's Congress and the Chinese People's Political Consultative Conference, and public opinion information, our Administration has already put forward guiding opinions for local quality inspection departments to carry out food and agricultural product certification supervision in 2014; at the same time, the key areas of this year's special supervision and inspection activities for food and agricultural product certification have been specified, namely HACCP certification activities of export food production enterprises and organic product certification activities (including imported organic products, organic tea, and organic product certification demonstration zones). This special supervision and inspection plan includes special supervision, inspection, and sampling of 130 certified enterprises and 350 organic products, specifically as follows:
(1) Special Supervision and Inspection of Certified Food and Agricultural Product Production Enterprises
1. Inspection of HACCP-certified export food production enterprises. In order to strengthen the linkage between the record-keeping supervision of export food production enterprises and HACCP certification supervision, improve certification effectiveness, promote the “quality improvement, efficiency enhancement, and upgrading” of export food production enterprises, and at the same time enhance the certification activity supervision capacity of directly affiliated inspection and quarantine bureaus, five directly affiliated entry-exit inspection and quarantine bureaus in Yunnan, Guangdong, Liaoning, Hebei, and Xiamen, where export food production enterprises are concentrated, shall carry out HACCP certification witnessed inspections of 50 export food production enterprises.
2. Inspection of organic product certified enterprises. According to the results of supervision and sampling in recent years, the phenomenon of unqualified organic tea product testing is relatively prominent, and supervision of the production and certification process needs to be strengthened. In Yunnan Province and Sichuan Province, the main tea-producing areas, the directly affiliated entry-exit inspection and quarantine bureaus and the provincial quality and technical supervision bureaus of the two places shall organize on-site witnessed inspections of 30 organic tea certified enterprises.
3. Supervision and inspection of organic product certification demonstration zones. After three consecutive years of carrying out organic product certification demonstration creation, the number of counties and cities nationwide carrying out such creation has reached 28. In order to ensure the quality of demonstration creation work and at the same time enhance the front-line certification supervision capacity of local areas, this year in Yanqing of Beijing, Yang County of Shaanxi, and Majiang of Guizhou, the bureaus recommended by the demonstration creation zones (respectively the quality and technical supervision bureaus of Beijing Municipality, Shaanxi Province, and Guizhou Province) shall organize supervision and inspection of 50 enterprises within 3 organic product certification demonstration zones.
(2) Supervision and Sampling of Organic Products
Carrying out sampling of certified products (especially from the circulation domain) is an important means of understanding the overall quality status of organic product certification and discovering certification risks. This year, sampling inspection will continue for major categories of organic products, such as organic tea, fruit, and grain, covering 350 products, and testing will be conducted on 250 certified products (sample sources include: witnessed inspection enterprises, market-purchased samples, and organic product certification demonstration zones). Market sampling will mainly be carried out in Beijing, Shanghai, Guangdong, Tianjin, and Jiangsu, where organic product consumption is relatively concentrated. The organic product sampling work in the above areas shall be the responsibility of the local quality and technical supervision bureaus. The testing of certified products shall be undertaken by the Comprehensive Testing Center of the Chinese Academy of Inspection and Quarantine, the National Tea Quality Supervision and Inspection Center (Hangzhou), the Animal, Plant and Food Testing Center of Jiangsu Entry-Exit Inspection and Quarantine Bureau, the Guangdong Product Quality Supervision and Inspection Research Institute, and the Food and Cosmetics Quality Inspection Institute of the Shanghai Institute of Quality Inspection and Technical Research.
(3) Special Supervision and Inspection of Imported Organic Products
In accordance with the relevant provisions of the "Measures for the Administration of Organic Product Certification" (Order No. 155 of the General Administration of Quality Supervision, Inspection and Quarantine), all directly affiliated entry-exit inspection and quarantine bureaus are responsible for inspecting imported organic products. At the beginning of the year, our Administration organized the formulation of the "Guidelines for Entry Inspection of Organic Products." However, since the regulations were newly implemented, there still exist phenomena such as inadequate understanding by various localities of the provisions of the "Measures" and the "Guidelines," inaccurate determination of declared categories, inconsistent standards of control, and untimely information communication among port bureaus, which has given some law-breaking enterprises opportunities to exploit. To solve this problem, in the form of special supervision and inspection, major port bureaus shall be organized to jointly carry out supervision and inspection of imported organic products, so as to strengthen information communication among bureaus, unify standards, promptly handle newly discovered problems, and promptly understand the overall situation of imported organic products, thereby providing a scientific basis for the next step of risk monitoring and the development of international mutual recognition of organic products. The special supervision and inspection shall be carried out by 10 directly affiliated entry-exit inspection and quarantine bureaus, including Beijing, Tianjin, Shanghai, Liaoning, Jiangsu, Zhejiang, Guangdong, Shenzhen, Zhuhai, and Shandong.
II. Organizational Arrangements
This special supervision and inspection shall be uniformly organized by the Registration Department of the CNCA, with technical support provided by the China National Accreditation Service for Conformity Assessment and the Certification and Accreditation Research Institute. Each bureau shall separately carry out supervision and inspection, with emphasis on enhancing the food and agricultural product certification supervision capacity of front-line local quality inspection personnel and, in conjunction with specific cases, strengthening regulatory linkage.
For the special supervision and inspection of certified food and agricultural product production enterprises, the China National Accreditation Service for Conformity Assessment shall be the lead unit and shall be responsible for planning the scheme, organizing accreditation assessors and other technical experts to go to Liaoning, Yunnan, and Sichuan to explain the inspection scheme to personnel participating in the special supervision and inspection, and to demonstrate the on-site supervision and inspection and witnessed inspection of enterprise certification. The China National Accreditation Service for Conformity Assessment shall summarize and analyze the special supervision and inspection of certified production enterprises and form a summary report.
For the supervision and sampling of organic products, the Research Institute shall be the lead unit and shall be responsible for formulating the specific supervision and sampling plan, determining the sampling varieties, testing items, providing the information required for sampling, and coordinating the sampling progress; local quality and technical supervision bureaus shall be responsible for sampling and verifying the authenticity of certification, and shall send samples requiring testing to designated testing institutions; each testing institution shall test the sampled products. The Certification and Accreditation Technical Research Institute shall summarize and analyze the supervision and sampling situation and form a summary report.
For the special supervision and inspection of imported organic products, the Shanghai Entry-Exit Inspection and Quarantine Bureau shall be the lead unit, and the relevant directly affiliated inspection and quarantine bureaus shall implement it separately. The Shanghai Entry-Exit Inspection and Quarantine Bureau shall collect technical problems encountered during implementation and organize experts to study and resolve them, compile and analyze relevant import inspection information, and form a summary report.
The implementation period of the special supervision and inspection shall be from July to early October. Before October 15, each lead unit shall submit the summary report to the Registration Management Department of the CNCA. If violations discovered during supervision and inspection require follow-up handling, it shall be completed before the end of the year; if case filing and investigation are required, it shall be carried out in accordance with the time required by relevant provisions and procedures.
III. Use of Funds
The CNCA shall allocate funds uniformly according to the special supervision and inspection tasks undertaken by each unit, for use by each unit in implementing special supervision and inspection and participating in related activities such as explanation of inspection schemes by project lead units, on-site enterprise inspection demonstrations, and participation in inspection situation summarization and concluding activities. Each unit shall use the funds exclusively for their designated purpose, strictly carry out expenditures in accordance with financial regulations, and also summarize the use of funds in the summary report. The CNCA shall conduct performance assessment of fund expenditures in conjunction with supervision and inspection activities.
